PRIVACY POLICY FOR CUSTOMERS AND SERVICE PROVIDERS
We at Eassy Innovative Services Private Limited (“EISPL”) value the privacy of its users (“user” or “you”) and “Service Providers” (Users, you, and Service Providers are collectively referred to as “Registered Users”). This Privacy Policy (“Policy”) is published in accordance with the provisions of Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. This Policy describes the information that we collect about you when you visit our website www.eassy.life ("Website") (including any other media form, media channel, mobile website, or mobile application related or connected thereto) or install the Eassylife Mobile Application (“App”), use the services available on the Website and App (“Services”), and the manner in which we use and disclose that information. The Website and App are hereafter collectively referred to as the “Platform”.
Registered Users are requested to read the Policy before accessing the Platform and/or Services. Your use of the Platform and/or Services and any personal information you provide on the Platform shall remain subject to the Policy and EISPL’s terms of use available on [https://eassylife.com/terms-and-condition] (“Terms of Use”).
EISPL reserves its right to change, edit, alter, amend, modify, review, revise or substitute this Policy with or without notice. By using the Platform, the Registered User signify that they have carefully read, understood and agree to be bound by this Policy. Registered Users are encouraged to periodically review this Policy to stay informed of updates. Registered Users will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted unconditionally the changes in any revised Policy by their continued use of the Platform after the date that such revised Policy is posted.
EISPL reserves its right to refuse services to any Registered User who does not accept or violates the terms of this Policy.
Sensitive personal data or information (“Personal information”) is defined under Rule 3 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and means personal information relating to: (i) password; (ii) financial information such as Bank account or credit card or debit card or other payment instrument details; (iii) physical, physiological and mental health condition; (iv) sexual orientation; (v) medical records and history; (vi) Biometric information; (vii) any detail relating to (i) to (vi) as may be provided for providing a service; and (viii) any of the information received under (i) to (vii) for processing, stored or processed under lawful contract or otherwise. However, any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as Personal Information.
Personally identifiable information, such as the Registered User’s name, address, email address, telephone number, demographic information, such as age, gender, hometown, and interests, that the Registered User voluntarily gives to EISPL when registering with the Platform or when the Registered User chooses to participate in various activities related to the Platform such as online chat and message boards will also be covered under the scope of this Policy. The Registered User is under no obligation to provide EISPL with personal information of any kind, however refusal to do so may prevent the Registered User from using certain features of the Platform.
We collect personal information from Service Providers offering their services as well as Users availing of the services listed on the Platform. Service Providers and Users are required to create an account to be able to access certain portions of our Platform, such as to submit questions, participate in polls or surveys, to request a quote, submit a quote, and request for information. The information made available by the Service Provider is partially or completely accessible to the Users using the Platform, either directly or by submitting a request for a service. The information made available by the Users are partially accessible to the selected / appointed Service Provider.
Service Providers: When they create and use an account with EISPL, the Service Provider will be required to disclose and provide to EISPL information including personal contact details, bank details, personal identification details (such as PAN card, Aadhar card, phonebook, call logs etc.) and participate in polls or surveys or feedbacks etc. The information gathered from polls, surveys, feedback etc. / shall be utilized to ensure greater customer satisfaction and help a customer satiate their needs. The type of personal information that we collect from you varies based on your particular interaction with our Website or App.
Users: During the account registration process and during your usage of the Platform, we will collect information such as your name, gender, postal code, telephone, email address, date of birth, and other personal information. You also may provide us with your, mailing address, and demographic information (e.g., gender, age, political preference, education, race or ethnic origin, and other information relevant to user surveys and/or offers). We may also collect personal information that you post in your profile, or feedback section or in any comments or discussions you post in any blog, chat room, or when entering contests or giveaways and/or responding to surveys, or other correspondence with the Platform, or any comments you provide during dispute resolution with other users of the Platform. The User can add or update the User Information on a regular basis. When the user updates the User Information, EISPL may keep a copy of the prior version for its records
Financial information of Users: Data related to User payment method (e.g. valid credit card number, card brand, expiry date) that EISPL may collect when a User places an order, is stored by the payment processor. EISPL shall store only limited, if any, financial information collected by the server which includes invoice value, commission charged and taxes paid but does not include details of the payment mode i.e. credit card details or bank account details or passwords or PINs. Users are encouraged to review the privacy policy of the payment processors and contact them directly for responses to their queries and questions.
Service Providers: If you are a Service Provider and would like to post any information about yourself, we will require you to register for an Account. During the Account registration process, we will collect your business name, mobile number, address, pin code, service location preferences, a description of you and your services, a headline for your profile, first and last name, and email address (optional). Other information may also be required to be provided to EISPL whilst you avail and use the Platform. In addition, you may, but are not required to, provide other content or information about your business, including photographs and videos. We also may collect payment information, such as credit and debit card and / or payment wallet or any other form of financial account information, from you.
Background Verification: The Service Provider acknowledges that as part of the on-boarding process, EISPL or an entity /agency appointed / nominated by EISPL (“Verifier”), may undertake background verification checks of the Service Provider in order to authenticate inter alia the genuineness and competency of the Service Provider. In light of the above, the Service Provider expressly consents to and acknowledges the following:
EISPL reserves the right to record the conversations between Service Providers and the Users facilitated by EISPL through the messaging/chat mechanism on the platform or the calls made through the virtual numbers provided to safeguard the privacy of Users and Service Providers. All the chat/messaging logs or call recordings may be used to (but not limited to) monitor and prohibit abuse, safeguard the rights of the Users and Service Providers, as well as for resolving disputes.
If we deem it necessary, in our sole and absolute discretion, we may also ask for and collect supplemental information from third parties, such as information about your credit from a credit bureau (to the extent permitted by law), or information to verify any identification details you provide during registration.
Information from the App – applicable for all Registered Users
We and our third party service providers, which include ad networks, use cookies, web beacons, and other tracking technologies to collect information about your use of our Platform and Services, such as your browser type, your ISP or operating system, your domain name, your access time, the URL of the previous website you visited, your page views, your IP address, and the type of device that you use. We also track how frequently you visit our Platform and use our Services. We use this information (including the information collected by our third party service providers) for analytics (including to determine which portions of our Platform are used most frequently, what our users like/do not like), to assist us in determining relevant advertising (both on and off our Platform ), to evaluate the success of our advertising campaigns, and as otherwise described in this Policy. Currently, we do not honour browser requests not to be tracked.
We may obtain your device ID, which is sent to EISPL’s servers and used in fraud prevention efforts.
Cookies: We and our third party service providers collect information from you by using cookies. A cookie is a small file stored on the Registered User's computer hard drive containing information about the User. The cookie helps us analyse web traffic or informs you about your use of a particular website. Cookies allow web applications to respond to you as an individual, tailoring its operations to your needs, likes and dislikes by gathering and remembering information about your preferences. When you visit the Platform, we may send one or more cookies (i.e., a small text file containing a string of alphanumeric characters) to your computer that identifies your browser.
Some of these cookies may be connected to third-party companies or websites. The terms of use of such cookies are governed by this Policy and the privacy policy of the relevant third party company or website.
Disabling Cookies: You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you disable cookies you may be prevented from taking full advantage of the Platform because it may not function properly if the ability to accept cookies is disabled.
Clear GIFs, pixel tags and other technologies: Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer's hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (a.k.a. web beacons, web bugs or pixel tags), in connection with our Platform to, among other things, track the activities of Platform visitors, help us manage content, and compile statistics about Platform usage. We and our third party service providers also use clear GIFs in HTML emails to our customers, to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.
We collect your personal information and aggregate information about the use of our Platform and Services to better understand your needs and to provide you with a better Platform experience. Specifically, we may use your personal information for any of the following reasons:
EISPL may share User information under following circumstances:
We may disclose your information including Personal Information if: (i) EISPL reasonably believes that disclosure is necessary in order to comply with a legal process (such as a court order, search warrant, etc.) or other legal requirement of any governmental authority, (ii) disclosure would potentially mitigate our liability in an actual or potential lawsuit, (iii) reasonably necessary to enforce this Privacy Policy, our Terms of Use etc. (iv) disclosure is intended to help investigate or prevent unauthorized transactions or other illegal activities, or (v) necessary or appropriate to protect our rights or property, or the rights or property of any person or entity.
We may contract with various third parties for the provision and maintenance of the Platform, and our business operations, and EISPL may need to share your personal information and data generated by cookies and aggregate information (collectively, "information") with these vendors and service agencies. For example, we may provide your information to a credit card processing company to process your payment. The vendors and service agencies will not receive any right to use your personal information beyond what is necessary to perform its obligations so that the User may avail of the Services. If you complete a survey, we also may share your information with the survey provider; if we offer a survey in conjunction with another entity, we also will disclose the results to that entity.
With a User’s consent, EISPL may share User information with third parties for marketing purposes.
If you are a User then your name, and location, as well as the details of your request, are available to all visitors to our Platform. Service Providers who have been engaged by the User will be permitted to see the User's full name, mobile number, email address and the -location. If a User interacts with other users of the Platform, the latter may see the name, profile photo, and descriptions of former’s activity, including sending invitations to other users, chatting with other users, liking posts, following blogs. If you are a Service Provider, the information that you post (other than your payment information) is available to other Users of our Platform. Comments that Users post on our Platform also will be available to other visitors to our Platform. In addition, we will post the results (in aggregate form) of surveys on our Platform.
A User posting comments, contributions or other content to the Platform, which may be viewed by all Registered Users and may be publicly distributed outside the Platform in perpetuity.
EISPL may share User information with its affiliates, in which case EISPL will require those affiliates to honour and comply with this Privacy Policy. Affiliates include EISPL’s, parent company, subsidiaries, joint venture partners, business partners, or other companies that are controlled or are under common control of or with EISPL.
Change of Control or Bankruptcy
In the event that EISPL undergoes a change in control, including, without limitation, a merger or sale of all or substantially all of EISPL's assets to which this Platform relates or other corporate reorganization in which EISPL participates, and is thus merged with or acquired by a third party entity (a "Successor"), EISPL hereby reserves the right to transfer the information we have collected from the Users and Service Providers of the Platform to such Successor.
In addition, in the event of EISPL's bankruptcy, reorganization, receivership, or assignment for the benefit of creditors, or the application or law or equitable principles affecting creditors' rights generally, EISPL may not be able to control how your information is transferred, used, or treated and reserves the right to transfer the information we have collected from the Users and Service Providers of the Platform to non-affiliated third parties in such event.
We may share your personal information with Service Providers to whom you explicitly ask us to send your information or if you explicitly consent to such disclosure upon receipt of a specific Service. For instance, when you contract for a specific Service with a Service Provider, EISPL will send that Service Provider a notice that includes the personal information that you have chosen to allow EISPL to reveal to Service Providers with whom you contract.
The Platform may contain links to third-party websites and applications of interest, including advertisements and external services, that are not affiliated with EISPL. Once a User has used these links to leave the Platform, any information provided by the User to these third parties is not covered by this Privacy Policy. EISPL cannot guarantee the safety and privacy of User information. EISPL is not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services or applications that may be linked to the Platform. Your use of any external website shall be subject to the terms of use and privacy policy located on the external website.
You may choose to restrict the collection or use of your personal information in the following ways:
You can review, correct and delete your personal information by logging into the Platform and navigating to your preferences page in "Edit Profile." You must promptly update your personal information if it changes or is inaccurate. Typically, we will not manually alter your personal information because it is very difficult to verify your identity remotely. Nonetheless, upon your request we will close your Account and remove your personal information as soon as reasonably possible based on your Account activity and in accordance with applicable law. We do retain information from closed Accounts to comply with the law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations of any Registered Users enforce our Terms of Use, and take any other actions otherwise permitted by law that we deem necessary in our sole and absolute discretion. You should understand, however, that once you publicly post a Request, Offer, Want, Feedback, or any other information onto the Platform, you may not be able to change or remove it. Once we have deleted or removed your Account, you agree that EISPL shall not be responsible for any personal information that was not included within your deleted and/or removed Account that remains on the Platform.
We may send periodic promotional or informational emails to you. You may opt-out of such communications by following the opt-out instructions contained in the email. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving emails about recommendations or other information we think may interest you, we may still send you emails about your Account or any Services you have requested or received from us.
We participate in third party ad networks that may display advertisements on other websites based on your visits to our Platform as well as other websites. This enables us and these third parties to target advertisements by displaying ads for products and services in which you might be interested. Third party ad network providers, advertisers, sponsors and/or traffic measurement services may use cookies, JavaScript, web beacons (including clear GIFs), Flash LSO and other technologies to measure the effectiveness of their ads and to personalize advertising content to you. These third party cookies and other technologies are governed by each third party's specific privacy policy, and not by EISPL’s Policy. We may provide these third-party advertisers with information about your usage of our Platform and our services, as well as aggregate or non-personally identifiable information about visitors to our Platform users of Services available on the Platform.
As a Registered User of the Platform you will select a Full Name during the registration process. All of your activities on the Platform will be traceable to your Full Name. Service Providers with whom you have transacted business via the Platform, can see a large part of your activity on the Platform. If you book a service with a Service Provider, cancel a scheduled service with a Service Provider, receive an offer on your posted service from a Registered User, or have posted a service, EISPL may send a notice to you or the appropriate Registered User that includes your Full Name. Thus, if you associate your real name with your Full Name, the people to whom you have revealed your name may be able to personally identify your activities on the Platform.
The Platform facilitates your sharing of personal information with others in order to negotiate, provide, and use the Services. If you agree to contract for a service with a Service Provider, you may need to reveal your name, email, mobile number, or personal address to that individual so that the service may be performed. Please respect the privacy of others. You agree to use the information of other users solely for the following purposes: (a) EISPL-transaction-related purposes; and (b) using Services offered through the Platform.
Your password is the key to your Account. When creating your password it is recommended you should use unique numbers, letters, special characters, and combinations thereof. In addition, DO NOT disclose your password to anyone. If you do share your password or your personal information with others, you are solely responsible for all actions taken via your Account. If you lose control of your password, you may lose substantial control over your personal information and be subject to legally binding actions taken on your behalf. Thus, IF YOUR PASSWORD HAS BEEN COMPROMISED FOR ANY REASON, YOU MUST IMMEDIATELY NOTIFY EISPL TO CHANGE YOUR PASSWORD.
We invite you to post content on our Platform, including your comments, feedback, pictures, and any other information that you would like to be available on our Platform. If you post content to our Platform, all of the information that you post will be available to all visitors to our Platform. Your posting may become public and EISPL cannot prevent such information from being used in a manner that may violate this Policy, the law, or your personal privacy.
EISPL uses administrative, technical, and physical security measures to help protect the personal information of the Registered Users. Registered Users ought to be aware that despite EISPL’s efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, EISPL cannot guarantee complete security of personal information provided by Registered Users. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. EISPL is not responsible for the unauthorized use of your information or for any lost, stolen, compromised passwords, or for any activity on your Account via unauthorized password activity.
EISPL does not knowingly solicit information from or market to children under the age of 18. If a Registered User becomes aware of any data that have been unknowingly collected by EISPL from children under age 18, please contact EISPL using the contact information provided below.
This Policy is to be read in conjunction with and shall be deemed to be part of the Platform’s Terms of Use.
The Registered User information resides in EISPL’s database for a certain period of time even after the user ceases to use or access the Platform and in such cases EISPL is not liable for any usage of the Registered User information after the Registered User ceases to use or access the Platform.
THIS POLICY IS CURRENT AS OF [24th SEPTEMBER 2021]. EISPL MAY, IN ITS SOLE AND ABSOLUTE DISCRETION, CHANGE THIS POLICY FROM TIME TO TIME BY UPDATING THIS DOCUMENT. EISPL WILL POST ITS UPDATED POLICY ON THE PLATFORM ON THIS PAGE. EISPL ENCOURAGES YOU TO REVIEW THIS POLICY REGULARLY FOR ANY CHANGES. YOUR CONTINUED USE OF THIS PLATFORM AND/OR CONTINUED PROVISION OF PERSONAL INFORMATION TO US WILL BE SUBJECT TO THE TERMS OF THE THEN-CURRENT POLICY.
